LEGALITY OF ONLINE GAMBLING IN DIFFERENT COUNTRIES

Internet gambling is a growing industry. The legality of online gambling is a complicated issue, as it depends on the player's location. Some countries do not have specific online gambling laws and some do not care. However, some countries regulate or encourage online gambling and some jurisdictions to ban online gambling.

Before the 1990s, people in the United States who want to place bet or gamble basically have two choices. They could travel to legitimate gaming establishment or place an illegal bet through a bookmaker. The emergence of the internet in the mid 1990s changes the gambling world. New form of gambling appeared such as online game casinos and sports wagering. Internet gambling can take place on any electronic device that offers Internet access anywhere on the globe.

Both federal and state laws apply to Internet gambling in the United States. Wire Act is the federal statute that has been used to prosecute federal Internet gambling cases while Travel Act and the Illegal Gambling Business Acthave been used to prosecute gambling entities international bets over the telephone and internet gambling activity. Like the United States, other countries have enacted laws that explicitly prohibit internet gambling under certain conditions or rely on existing laws to prosecute their activities.

In Australia, the government passed the Interactive Gambling Act (IGA) on 28 June 2001 and is an odd legal position in Australia. It is not an illegal for Australian citizen to play poker room or online casino. Besides that, many state government licensed sports betting online in business, such as Centrebet, Sportingbet and Betfair. It seems that unconcerned by threat of prosecution and cannot be prosecuted in Australia.

In Hong Kong, gambling is illegal unless specifically permitted under the Gambling Ordinance. The ordinance permits several forms of gambling such as pari-mutuel betting and lotteries. Offshore gambling including internet gambling is voted to ban by Hong Kong Legislative Council. This legislation criminalizes both offshore betting and bookmaking. The passage of the 2002 Amendment gave the Hong Kong Jockey Club complete control of the gaming market. The club solicits pari-mutuel bets from around the world and operates weekly government lottery. However, Hong Kong law provides criminal penalties for any offshore gambling agent promote or advertise their gaming activities. Financial institutions such as banks and credit card companies based in Hong Kong are also prohibited from processing betting transactions to prevent their residents from placing internet bets using credit cards or similar means of payments.

In our country Malaysia, all forms of sports betting are against our country law except horse racing. Placing wagers on horse races is allowed only on certain tracks and is strictly regulated by the Malaysian Racing Association. In the other hand, Malaysia is prohibiting with the online gambling and there are no legal Malaysian sportsbooks or bookmakers operated in our country. The government does not give the licenses to open internet gambling sites in the country. Recently, Ascot Sports Sdn Bhd submit a proposals to the government to issue out the football betting license but this proposals was reject by the government after Umno supreme council meeting. Besides that, the proposal is also been cancelled due to huge objection by opposition political parties and our country residents. It is because they want to avoid losing tax revenue of over $1 billion every year. However, there are still a lot of underground and black market sports betting in our country. Even though, Malaysia government restrict online gambling in country but Malaysian players still can access to the foreign internet gambling sites. This is the most difficulties issue for the Malaysia government to solve the annoyance problem.
